West Viginia DNR Wildlife Resources Section Files Legislative Rules For Review
Hunting Regulations
This rule is being amended to allow the taking of more than one
deer per day provided the first deer is checked with a conservation
officer or at an official game checking station; clarify that
waterfowl hunters may use nontoxic shot larger than No. 4; and
clarify that if two deer are taken in counties closed to bucks
only firearm hunting, one of the deer must be antlerless.
Prohibitions When Hunting and Trapping
This rule is being amended to make it illegal to feed and/or take,
or attempt to take, by the aid of baiting any game animal or game
bird on any public lands at any time; make it illegal to take, or
attempt to take, any deer, bear or boar by the aid or use of any
electronic calls; clarify that a person legally hunting waterfowl
during the muzzleloader deer season may possess nontoxic shot
shell containing larger than No. 4 but may not possess solid
ball ammunition; and clarify that it is illegal for any person
to use a modified bow for the purpose of hunting or fishing
unless he or she possesses a special permit to do so issued
by the director.
After the public review and comment period closes July 15, 2002,
appropriate changes will be made to any of the proposed rules
and they will be refiled by the DNR for action by the Legislative
Rule Making Committee prior to the 2003 legislative session.
Provided the rules are not changed and are approved during the
2003 legislative session, they will become effective in March of 2003.
